These Terms of Service ("Terms") govern the "GTM & ROI Diagnostic" service (the "Service") offered by Focalytics ("we", "us"). By booking the Service, you ("Client") agree to be bound by these Terms.
1. Scope of Service
The Service is a fixed-scope, two-week diagnostic designed to provide clarity on your marketing performance and actionable recommendations for GTM strategy and budget allocation. Core components include:
- Data integrity and completeness assessment
- Channel performance analysis
- Attribution review and validation
- Strategic recommendations report
The Service includes a 1-hour final executive call after the two-week analysis to review findings.
2. Free Consultation
Before commencing the Service, we offer a 30-minute consultation call at no charge. If both parties agree to proceed, the Client will pay a $2,500 fee to begin the two-week audit.
3. Payment and Refund Policy
- Full payment is required upfront to secure your slot and commence the Service.
- Satisfaction Guarantee: If the Client is not satisfied with the diagnostic findings after the final 1-hour call, a refund of up to 100% of the fee may be requested within 7 days of that call. We may ask for feedback to improve service quality. Refunds are at the sole discretion of Focalytics and are subject to these Terms.
4. Data Quality Contingency
The Service relies on sufficient and accurate data. If, during the initial assessment, we determine that the Client's data is too incomplete or unreliable to provide meaningful analysis:
- We may cancel the audit.
- A fee of $500 will be retained to cover the initial assessment and work performed.
- The remaining $2,000 will be refunded to the Client.
- We will provide a detailed explanation of why the data quality is insufficient, so the Client can address issues for future analysis.
5. Client Obligations
To ensure the success of the Service, the Client agrees to:
- Provide secure access to all relevant data sources in a timely manner.
- Appoint a technical point of contact for any questions regarding data access.
- Warrant that they have the legal right to share the data provided for the purposes of the audit.
Delays in access may result in project extensions or rescheduling.
6. Client Portal and Data Handling
We may use the client portal or other secure methods to deliver reports and manage credentials. All client data is treated as confidential and encrypted in transit and at rest.
7. Intellectual Property & Confidentiality
- Client Ownership: The Client retains ownership of their data and final deliverables.
- Focalytics Ownership: We retain ownership of our proprietary methods, tools, and frameworks.
- Confidentiality: Both parties agree to treat all non-public information as confidential.
8. Disclaimer of Warranties
The Service is provided "as is." We make no warranties regarding specific business outcomes or revenue increases. Our goal is to provide actionable insights to inform strategic decisions.
9. Limitation of Liability
Our total liability for claims arising out of this engagement shall not exceed the total fees paid by the Client.
10. Governing Law
These Terms shall be governed by the laws of Netherlands.
